Client Agreement
Version October 2026. Plain English, no long-term contract. You sign this before your build starts.
1. Who this is between
This agreement is between KingsWay Sites, a web design business run by Scott McArthur as a sole proprietor in Wrentham, Massachusetts ("KingsWay", "I"), and the business owner signing below ("you").
Your project details (site size, plan, add-ons, price and payment option) are listed on the signature page or in the email that sends you this agreement. Together they make up the whole deal.
2. The free mock
Before you pay anything, I build a free mock of your homepage and send you a private link. If you don't like it, you owe nothing and the mock is deleted.
3. The build
Builds are priced by size: 5 pages for $2,500, 8 pages for $3,500, 11 pages for $4,500. Extra pages are $400 each.
Pay in two halves: 50% to start production and 50% when the site goes live. Or use the payment plan: $350 to start, then the rest of the build in 12 equal monthly payments charged to the card you save at checkout. If you cancel your monthly plan before the payment plan is finished, the rest of the build balance is still owed.
Most sites launch in 2 to 3 weeks after I have your content (logo, photos, services, towns and any text you want used). If content comes in late, the launch date moves with it.
Before launch you can request reasonable changes to the pages we agreed on. New pages or features beyond what we agreed are quoted separately.
After launch you get 30 days of fixes for anything that doesn't work the way we agreed, at no charge.
4. What you're responsible for
You send the content for your site and confirm you have the right to use it: your logo, photos, text and any reviews or brand names you ask me to show.
You make sure what your site says about your business is accurate, including prices, licenses, insurance and service claims.
If you use your leads for texts or emails, you follow the rules that apply to that, like getting consent before texting someone.
5. The monthly plan
Every site needs a monthly plan: Starter at $59 a month, Growth at $99 a month, Pro at $199 a month. It starts when the site goes live and is billed monthly through Stripe.
Cancel anytime, no long-term commitment. Your plan ends at the end of the billing period. Your site stays up for up to 30 days after that, and I send you all of your site information (words, photos, files and domain access) within 72 hours of you asking.
If a payment is more than 14 days late, I'll email you first, then I may pause the site until it's paid. Nothing is deleted while it's paused.
Edit time included in your plan resets every month and doesn't roll over. Edits past that are $100 an hour, one-hour minimum, and only when you ask for them.
6. Who owns what
Your content is always yours: your words, photos, logo, leads and domain.
The site's code and design are built on KingsWay's own system and run on KingsWay hosting. Once your build is paid in full, you can get a copy of your site's code to host anywhere for a one-time $99 handoff fee.
I reuse my own general code and components across client sites. I never reuse your content, photos or brand on anyone else's site.
7. Your domain
If I buy your domain for you, it's registered in your name. Setup is $75 including the first year, then $35 a year to renew. Connecting a domain you already own is free. I'll transfer it to you whenever you ask.
8. Your leads and data
Leads from your site's forms are emailed to you and stored in your private dashboard. I only access them to run and support your site. I never sell or share them.
Your site gets its own privacy policy in your business name that explains this to your visitors.
If you cancel, I'll export your leads to you on request and delete them from my systems within 30 days.
9. Services the site runs on
Your site uses outside services, including Vercel (hosting), Supabase (database), Stripe (payments), Twilio (text alerts) and Google (Search Console and your business profile). I pick reliable ones and keep an eye on them, but I'm not responsible for their outages, price changes or policy changes. If one changes in a way that affects you, I'll tell you and help you sort it out.
10. No ranking guarantees
I build every site to be fast and set up for local search, but no one controls Google. I don't guarantee rankings, traffic, leads or sales.
11. Limits
If something goes wrong, KingsWay's total responsibility is limited to what you paid me in the 3 months before the problem. I'm not responsible for lost profits or other indirect losses.
Nothing in this agreement limits rights you have under Massachusetts law that can't be limited.
12. Credit and referrals
Your site's footer includes a small "Website by KingsWay Sites" link. I only feature your site on kingswaysites.com with your OK.
Refer another business and you get a $250 credit toward your monthly plan once they sign on, and they get $250 off their build.
13. The fine print
Massachusetts law applies. Changes to this agreement have to be in writing, and email counts. If one part turns out to be unenforceable, the rest still stands.
Either of us can end the project before launch with written notice. You pay for work done up to that point, and the start payment covers that unless we agreed otherwise.
