Partner Agreement
Version October 2026. You agree to this when you apply to the partner program.
1. Who this is between
This agreement is between KingsWay Sites, a web design business run by Scott McArthur as a sole proprietor in Wrentham, Massachusetts ("KingsWay"), and the person who applies to be a partner ("you"). You're an independent contractor, not an employee, agent or partner in the legal sense. You set your own hours, pay your own taxes and can't sign anything on KingsWay's behalf.
2. Partner types and commission
Referral Partner: you introduce a business owner. When their website build is paid in full, you earn $250. No recurring commission.
Sales Partner (by invitation): you find the business, get the free-mock questions filled out and stay their point of contact through launch. When the build is paid in full you earn 10% of the build price, and you earn 15% of every monthly plan payment the client makes during their first 12 months.
If a client uses the payment plan, the build counts as paid in full for your commission once their $350 start and 3 monthly build payments have cleared.
Commission is figured on what the client actually pays, before any discount KingsWay chooses to give. Add-ons, extra edits, domains and one-time services don't earn commission unless KingsWay agrees in writing.
3. How you get credit
A client counts as yours when they first fill out a KingsWay form through your partner link, or when Scott records you as their partner before they pay. Your link is remembered in their browser for 90 days.
If two partners claim the same client, the first one recorded gets it. Existing KingsWay clients and businesses already talking to KingsWay don't count as new referrals.
4. When you get paid
Commission is earned only when the client's payment clears in Stripe (or Scott logs a cash or check payment). Nothing is owed on money that hasn't been collected.
Payouts go out monthly, on the 15th, for everything earned through the end of the previous month, by ACH, Zelle or Venmo. You need a W-9 on file before your first payout.
If a client cancels within 90 days of their first monthly plan payment (or before launch), the upfront commission on that client is voided if it hasn't been paid yet, or subtracted from your next payout if it has.
Your dashboard shows every lead, client and commission line in real time.
5. How you represent KingsWay
Sell the free mock and point to the prices posted on kingswaysites.com. Don't quote custom prices, promise discounts, promise features or timelines, or promise rankings or results.
Be honest. No spam, no fake reviews, no pretending to be KingsWay staff, and no texting or emailing people who haven't agreed to hear from you.
You can use the KingsWay name and the materials Scott gives you to promote the program. Don't create your own KingsWay websites, ads that bid on the KingsWay name, or social accounts in KingsWay's name.
6. Client information
In your dashboard you'll see the business name, town and status of the clients you bring in, never their email or phone number. Keep anything you learn about a client's business private.
7. Ending the partnership
Either of us can end this at any time by email. Commission you've already earned is still paid. For Sales Partners, recurring commission on clients who signed before the end date keeps paying out for the rest of their first 12 months, unless the partnership ended because you broke these rules.
KingsWay can change the commission rates with 30 days' email notice. Changes don't affect commission on clients who already signed.
8. The fine print
Massachusetts law applies. KingsWay's total responsibility to you is limited to commission you've earned and haven't been paid. Changes to this agreement have to be in writing, and email counts.
